CSS Service Terms of Service

These CSS Service Terms of Service ("CSS Terms") govern your use of the free Google Comparison Shopping Service ("CSS Service") offered by Geiger Tamás e.v. (see section 16), operator of BrickHunter. They are separate from, and in addition to, the general Terms of Service that govern the BrickHunter website. By applying for or using the CSS Service you confirm that you have read and agreed to these CSS Terms. If you do not agree, do not apply for or use the CSS Service.
1. What the CSS Service is
BrickHunter is a Google-approved Comparison Shopping Service. The CSS Service lets you run your Google Shopping campaigns through the BrickHunter CSS instead of Google Shopping, so your listings enter the Shopping auction via our CSS. Under the European Commission's remedy, ads that run through an independent CSS are not subject to the margin Google applies to its own CSS, which can lower your effective cost-per-click.
We are the CSS partner only. We are not your advertising agency, we do not manage your campaigns, and we do not sell products through your Merchant Center.
2. The service is free
The CSS Service is provided free of charge. We do not charge a fee for associating your account with our CSS and we take no share of your advertising spend. You remain solely responsible for all costs you incur in Google Ads, including all click costs.
3. Eligibility and applying
To use the CSS Service you must operate a valid Google Merchant Center account and comply with Google's Merchant Center and Shopping ads policies. To apply, you provide us with your Google Merchant Center account ID(s) and the contact details requested in the application form. You confirm that you are authorised to associate those accounts with a CSS, and, where you apply on behalf of a company, that you are authorised to bind that company to these CSS Terms.
The Google Merchant Center Terms of Service and Google's Shopping ads policies continue to apply to your Merchant Center account while it is associated with our CSS, and you remain bound by them.
4. Granting Merchant Center access is optional
Associating your Merchant Center account with the BrickHunter CSS does not require you to grant us a user role on your account. Granting us access is entirely optional.
If you choose not to grant us access, the CSS association can still work, but our ability to help you diagnose or fix problems is limited, and in some cases support may be impossible - because we cannot see the configuration that is causing the issue. If you do grant us access, you may limit or revoke it at any time in Google Merchant Center, and you remain responsible for what you share.
5. No guarantees
The CSS Service is provided "as is" and "as available", without any warranty or service-level commitment of any kind, to the fullest extent permitted by law. Because the service is free, we specifically do not guarantee:
- any particular cost-per-click reduction, saving, ad position, impression volume, click volume, or sales;
- uninterrupted or error-free operation of the CSS association;
- that the CSS Service will remain available, unchanged, or free in the future;
- any specific response time for support requests.
The actual outcome of your Shopping campaigns depends on your bids, budgets, product data, competition, and Google's auction - all of which are outside our control.
6. Dependence on Google
We provide the CSS Service as a Google-approved comparison shopping service and depend on Google's continued operation of the CSS program and its underlying infrastructure. We are not responsible for, and provide no compensation in respect of:
- changes to, suspension of, or discontinuation of the Google CSS program or the terms of our participation in it;
- Google outages, auction changes, or changes to how any CSS-related benefit is calculated or applied;
- disapprovals, warnings, suspensions, or errors affecting your Google Merchant Center account or your Google Ads account.
You remain solely responsible for resolving any disapprovals or errors in your own Merchant Center and Google Ads accounts.
7. Your responsibilities
You are responsible for:
- your own Google Ads account, campaigns, budgets, and bids;
- the accuracy, quality, and policy-compliance of your product data in Merchant Center;
- complying with all applicable Google policies and applicable law;
- any consequences of granting, limiting, or revoking access to your Merchant Center account.
8. Switching and termination
You are never locked in. You may switch your Merchant Center back to Google Shopping or to another CSS at any time, without notice and without any fee. We may also suspend, withdraw, or discontinue the free CSS Service - in whole or in part, for you individually or generally - at any time, including where you breach these CSS Terms or Google's policies, or where continuing to offer the service for free is no longer viable. Where reasonably possible we will give advance notice; where a breach exposes us or third parties to legal or policy risk, we may act without prior notice.
9. Limitation of liability
To the maximum extent permitted by law, and given that the CSS Service is provided free of charge, we are not liable for any loss of profits, savings, sales, ad spend, data, or goodwill, or for any indirect, incidental, or consequential damages arising out of or in connection with the CSS Service, including any change in your advertising costs or performance.
Because the CSS Service is provided free of charge and you pay us nothing for it, our aggregate liability to you for any and all claims arising out of or in connection with the CSS Service is excluded to the fullest extent permitted by applicable law.
Nothing in these CSS Terms excludes or limits our liability for intentional wrongdoing, gross negligence, personal injury, or any other liability that cannot be excluded under applicable law.
10. Indemnification
You will indemnify and hold us (Geiger Tamás e.v.) harmless from and against any claims, losses, damages, liabilities, and reasonable costs and expenses (including reasonable legal fees) arising out of or in connection with: your product data, offers, or advertising; your use of the CSS Service; your breach of these CSS Terms; your violation of any Google policy or applicable law; or any infringement of a third party's intellectual property or other rights by content you supply or cause to be displayed. We will notify you of any such claim without undue delay, and you may participate in its defence at your own cost.
11. Confidentiality
We treat the data and information you share with us in connection with the CSS Service as confidential. We do not sell your data, and we do not share it with other merchants or with any other third party, except processors acting on our behalf as described in our Privacy Policy, or where we are required to do so by law. Being associated with the same CSS as other merchants does not give them any access to, or visibility of, your account, products, prices, or performance.
12. Data protection
The personal data you submit when applying for the CSS Service (your name, company name, business email, and Merchant Center account IDs) is processed as described in our Privacy Policy. We use it to evaluate your application, associate your account with our CSS, and contact you about the service.
13. Changes to these CSS Terms
We may update these CSS Terms from time to time to reflect changes in the CSS Service, in the Google CSS program, in applicable law, or in our operational needs. When we make material changes, we will update the "Last updated" date at the top of this page and, where the change significantly affects your rights, give reasonable notice by email or on this page before it takes effect. Your continued use of the CSS Service after the change takes effect constitutes acceptance of the updated CSS Terms. If you do not accept them, you may stop using the CSS Service and switch your Merchant Center to another CSS at any time (see section 8).
14. General
You may not assign or transfer your rights or obligations under these CSS Terms without our prior written consent. We may assign or transfer ours to a successor of the BrickHunter business or the CSS Service. These CSS Terms are the entire agreement between you and us regarding the CSS Service and supersede any prior understanding on the same subject. Any provision that by its nature should survive termination - including sections 9 (Limitation of liability), 10 (Indemnification), and 11 (Confidentiality) - survives.
15. Governing law and jurisdiction
These CSS Terms are governed by the laws of Hungary, without regard to conflict-of-laws rules, and any mandatory EU rules that apply to you. Any dispute arising out of or in connection with the CSS Service falls under the jurisdiction of the competent Hungarian courts, without prejudice to any mandatory statutory rights you may have where you are based.
If any provision of these CSS Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced by a valid one that most closely reflects the original intent.
